2. data processing when visiting this website

Every time you visit our website, data is collected that is required to provide the service. These are:

- Date and time of the retrieval

- YourIP address

- Login name

- Name of the retrieved file,

- transferreddataset,

- Message whether the retrieval was successful.

The data is temporarily processed in a log file. Before storage, each data record is anonymised by changing the IP address after 4 days.

The anonymised data is stored on a server beyond the time of the visit to the website. We are obliged to do this on the basis of Article 6 (1) (e) and (3) (b) of the Data Protection Regulation (DSGVO). This data is analysed and required in the event of attacks on the communication technology.

Data logged when accessing Linkando GmbH's website will only be passed on to third parties if we are legally obliged to do so or if the transfer is necessary for legal or criminal prosecution in the event of attacks on communications technology. Data will not be passed on in other cases.

When calling up individual pages, so-called temporary cookies are used to facilitate navigation. These session cookies do not contain any personal data and expire after the session. Techniques such as Java applets or Active-X controls, which make it possible to track the access behaviour of users, are not used.

b) GoogleTag Manager

This website uses the Google Tag Manager. This service allows website tags to be managed via an interface. The Google Tool Manager only implements tags. This means that no cookies are used and no personal data is collected. The Google Tool Manager triggers other tags, which in turn may collect data. However, the Google Tag Manager does not access this data. c) Google reCAPTCHA

We use the Google service reCaptcha to determine whether a human or a computer is making a certain entry in our contact or newsletter form. e) Text chat and audio/video

The service provider Nexmo Inc., 501 2nd Street, Suite 310, San Francisco, CA 94107, USA(https://tokbox.com) is used for the electronic transmission of text messages, audio, video and screen sharing data. In order to set up the audio and video conference, technical information is transmitted by the internet browser to Nexmo Inc. (e.g. IP address, browser type, set language, date and time) and, if necessary, used for the procedure and statistically evaluated. This data is processed separately, not assigned to any natural person and then deleted regularly.

f) Visitor action pixel Facebook

Our website uses the visitor action pixel from Facebook, Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA ("Facebook") to measure conversions. This allows the behaviour of page visitors to be tracked after they have been redirected to the provider's website by clicking on a Facebook advertisement. This allows the effectiveness of the Facebook ads to be evaluated for statistical and market research purposes and future advertising measures to be optimised.

The data collected is anonymous for us as the operator of this website, we cannot draw any conclusions about the identity of the users. However, the data is stored and processed by Facebook so that a connection to the respective user profile is possible and Facebook can use the data for its own advertising purposes in accordance with the Facebook data use policy. This allows Facebook to serve advertisements on Facebook pages as well as outside of Facebook. This use of the data cannot be influenced by us as the site operator.

The use of Facebook Pixel is based on Art. 6 para. 1 DSGVO. The website operator has a legitimate interest in effective advertising measures including social media. We have integrated YouTube videos into our online offer, which are stored on http://www.YouTube.com and can be played directly from our website. These are all integrated in "extended data protection mode", i.e. no data about you as a user is transmitted to YouTube if you do not play the videos. Only when you play the videos will the data mentioned in paragraph 2 be transferred. We have no influence on this data transfer. We have also integrated content from the following third-party providers on this website: Google Maps and Google Web Fonts (external fonts).

h) Matomo

(1)Scope and description of the processing of personal data

Our website uses "Matomo" (formerly "Piwik"), a web analytics service provided by InnoCraft Ltd, 150 Willis St, 6011 Wellington, NewZealand. Matomo stores cookies on your terminal device that enable an analysis of your use of our website. The information collected in this way is stored exclusively on our server, namely the following data:

- two bytes of the IP address of the calling system of the user

- the web page accessed

- the website from which the user accessed the website (referrer)

- The sub-pages that are called up from the called-up web page

- the length of stay on the website

- the frequency with which the website is accessed

Our website uses Matomo with the setting "Anonymize Visitors' IP addresses", which means that IP addresses are processed in abbreviated form, thus excluding the possibility of direct personal references. The software is set in such a way that the IP addresses are not stored in full, but that 2 bytes of the IP address are masked (e.g. 192.168.xxx.xxx). In this way, it is no longer possible to assign the shortened IP address to the calling computer. The IP address transmitted by your browser via Matomo is not merged with other data collected by us.

The legal basis for the processing of the user's data is Art. 6 para. 1lit. f DSGVO or § 15 para. 3 TMG.

We use Matomo to analyse the use of our website and individual functions and offers in order to continuously improve the user experience. Through the statistical evaluation of user behaviour, we improve our offer and make it more interesting for visitors.

(4)Duration of storage

The data of the processing described here will be deleted after a storage period of 90 days.

4. processing of personal data in the case of entries and enquiries

In connection with submissions and enquiries, we only process data that is necessary to communicate with you and to properly document the business processes. This includes, in particular, personal information (e.g. surname, first name, address, e-mail address, etc.) that we have received directly from you as well as information about the contact channel you have chosen (letter, telephone, e-mail, contact form). The processing of the data is necessary for the performance of our tasks (cf. Article 6(1)(e) and (3)(b) DSGVO in conjunction with Section 3 BDSG).

We will only pass on the data we receive from you to third parties if you have expressly consented to this or if we are obliged to do so by law or on the basis of a court decision. The storage of submissions and enquiries in electronic form - as well as in paper form - is carried out in accordance with the statutory periods applicable for the storage of written material.as a rule, the storage periods for this are 10 years.

5 Further processing of personal data

a) Newsletter dispatch

If you register on the Linkando GmbH newsletter distribution list, your e-mail address, the newsletter you have chosen and optionally your name will be stored on a server. The processing of the data is based on your consent in accordance with Article 6(1)(a) DSGVO. We use this data for sending the newsletter. We do not pass on your data to third parties or use it for any other purposes of our own.

When registering, your data will be stored on a server and a confirmation message with a link to the final registration will be generated to the e-mail address you have provided. If you do not confirm the registration by clicking on the link in this e-mail, the data will be deleted after 7 days. Otherwise, your data will be deleted immediately when you unsubscribe from the newsletter.

c) Registration for Linkando GmbH events

To participate in Linkando GmbH events, you usually have to register in advance. For organisational reasons, we need to collect your first name, surname, telephone number and email address in advance of the event in order to fulfil our tasks (public relations) in accordance with Article 6 (1) (e) and (3) (b) of the German Data Protection Act (DSGVO) in conjunction with Section 3 of the German Data Protection Act (BDSG).

Film and photo shoots: At some events, photos and films are taken as part of Linkando's press and public relations work. This is usually pointed out when entering the event. The recordings may be published on our website, social media channels, print media and other media.

The legal basis is Article 6 (1) (e) and (3) (b) DSGVO in conjunction with §3 BDSG and §23 Kunsturhebergesetz. If you do not agree with the photographs and publications, please contact the photographer responsible for finding the motif directly if possible.

e) Contacts with Linkando GmbH

When you contact Linkando employees or hand them business cards, for example, personal data (names of contact details) - insofar as this is necessary for the further fulfilment of tasks - is recorded in address and contact directories and deleted again as soon as it is no longer necessary or within the framework of our data protection deletion concept.

 

6. products provided by your organisation - note to end users

If you use a Linkando product with an account provided by an organisation you are affiliated with, such as your work or association account, that organisation may:

-Control and manage your Linkando product and product account, including controlling the privacy-related settings of the product or product account.

-Access and process your data, including interaction data, diagnostic data and the content of your messages and files associated with your Linkando product and product accounts.

If you lose access to your work or association account (for example, if you change employment), you may lose access to products and the content associated with those products, including those you have purchased on your own behalf if you have used your work or association account to sign in to such products.

If your organisation grants you access to Linkando products, your use of Linkando products may be subject to your organisation's policies. You should direct your privacy requests, including any requests to exercise your privacy rights, to your organisation's administrator. If you use social media features in Linkando products, other users in your network may see some of your activity. For more information about social media features and other features, please refer to the documentation or help content for the Linkando product. Linkando is not responsible for the privacy or security practices of our customers, which may differ from those stated in this Privacy Policy.

When you use a Linkando product provided by your organisation, the processing of your personal data by Linkando in connection with that product is subject to a contract between Linkando and your organisation. Linkando processes your personal data in order to provide the product to your organisation and to you, as well as for Linkando's legitimate business operations in connection with the provision of the product. 7. data subject rights

Both in the context of fulfilling our tasks and as a contractual party under civil law, Linkando GmbH is responsible for processing personal data. The following rights from the GDPR are therefore available to data subjects:

a) Right of access - Article 15 GDPR

The right of access provides the data subject with a comprehensive insight into the data concerning him or her and some other important criteria such as the purposes of processing or the duration of storage. The exceptions to this right regulated in §34BDSG apply.

b) Right of rectification - Article 16 GDPR

The right of rectification includes the possibility for the data subject to have inaccurate personal data concerning him or her corrected.

c) Right to erasure - Article 17 DS-GVO

The right to erasure includes the possibility for the data subject to have data deleted from the person responsible. However, this is only possible if the personal data concerned is no longer necessary, is being processed unlawfully or if the relevant consent has been revoked. The exceptions to this right regulated in §35 BDSG apply.

d) Right to restriction of processing -Article 18 GDPR

The right to restriction of processing includes the possibility for the data subject to prevent further processing of personal data concerning him or her for the time being. A restriction occurs primarily during the review phase of other rights that the data subject has exercised.

e) Right to data portability - Article 20 GDPR

The right to data portability includes the possibility for the data subject to receive the personal data concerning him or her from the controller in a common, machine-readable format in order to have it forwarded to another controller, if necessary.

f) Right to object - Article 21 GDPR

The right to object includes the possibility for data subjects to object to the further processing of their personal data in a specific situation, insofar as this is justified by the performance of public tasks or public and private interests. According to Section 36 of the BDSG, the right does not apply if a public body is obliged to process the data by law.

g) Right to withdraw consent

Insofar as the processing of personal data is based on your consent (Article 6 (1) (a) DSGVO), you may revoke this consent for the corresponding purpose at any time. The lawfulness of the processing based on your consent remains unaffected until receipt of your revocation.
